Medical Malpractice
Medical malpractice lawsuits result when a person, the plaintiff, alleges that negligent medical treatment
provided by a health care professional including, doctors, physicians, surgeons, psychiatrists or dentists,   or by a health care organization including hospitals, clinics or nursing homes, resulted in a serious injury, permanent harm or death.

Typically, the injured person or a related family member hires an attorney to file a claim with the medical provider’s insurance carrier requesting compensation for the injury.  Once a medical malpractice claim is filed, the insurance carrier may settle, negotiate with the claimant over the amount of compensation, or refuse to compensate the claimant.  If the parties do not come to an agreement, the plaintiff’s attorney can file a lawsuit in the appropriate court or abandon the claim.

Some states require a review of medical malpractice claims before a panel of experts prior to filing a lawsuit.  Other states mandate arbitration or alternative dispute resolution as a means of resolving medical malpractice claims.

Medical malpractice lawsuits usually result in one of several outcomes including:

-Settlement of the case prior to or during trial
-A trial decision in favor of the plaintiff or the defendant
-The dismissal of the case by the court.
-The lawsuit is abandoned or withdrawn
